ACCEPTANCE OF THE TERMS

These Terms of Use (the “Terms”) constitute a legally binding and enforceable agreement between Davors Facilities Management Services Limited, a company incorporated under the laws of the Republic of Ghana, operating the online marketplace known as Caanta Market (together referred to as the “Administrator”, “we”, “us”, or “our”), and you.

Caanta Market is an online marketplace operated under Davors Facilities Management Services Limited.

Your access to and use of the caanta.com website and any related web-based services, content, features, or data (collectively, the “Service” or “Platform”) are governed by these Terms.

If you do not agree to any part of these Terms, or if you are not eligible or authorised to be bound by them, you must not access or use the Service.

Please also review our Privacy Policy, which forms an integral part of these Terms. Any additional rules, policies, or documents posted on the Platform from time to time are hereby incorporated by reference. We reserve the right to amend these Terms at any time, with or without prior notice. Continued use of the Platform constitutes acceptance of the revised Terms.

ALL SERVICES PROVIDED BY THE ADMINISTRATOR ARE OFFERED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”. TO THE FULLEST EXTENT PERMITTED BY LAW, THE ADMINISTRATOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, QUALITY, AND NON-INFRINGEMENT.

THE ADMINISTRATOR DOES NOT CONTROL AND MAKES NO GUARANTEES REGARDING THE EXISTENCE, QUALITY, SAFETY, LEGALITY, OR AVAILABILITY OF GOODS OR SERVICES OFFERED BY USERS ON THE PLATFORM; THE ACCURACY OF USER CONTENT; THE ABILITY OF SELLERS TO SUPPLY GOODS OR SERVICES; OR THE ABILITY OF BUYERS TO PAY. THE ADMINISTRATOR IS NOT A PARTY TO TRANSACTIONS BETWEEN USERS AND DISCLAIMS ALL LIABILITY ARISING FROM SUCH TRANSACTIONS.

USERS ARE STRONGLY ADVISED TO INSPECT GOODS BEFORE PAYMENT AND TO CONDUCT THEIR OWN DUE DILIGENCE TO ENSURE COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS.

YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR PERSONAL SAFETY. ALL MEETINGS SHOULD TAKE PLACE IN SAFE, PUBLIC LOCATIONS AND DURING DAYLIGHT HOURS. THE ADMINISTRATOR SHALL NOT BE LIABLE FOR ANY USER INTERACTIONS.

ACCOUNT REGISTRATION

Certain features of the Service require registration of an account (“Account”). You agree to provide accurate, current, and complete information during registration.

You may register as an individual or as an authorized representative of a legal entity. Unless otherwise permitted, only one Account per user is allowed.

You are solely responsible for maintaining the confidentiality of your Account credentials and all activities conducted under your Account.

By using the Service, you confirm that you are at least 18 years of age, or that you are using the Platform under the supervision and consent of a parent or legal guardian.

The Administrator reserves the right to suspend, restrict, or terminate Accounts at its discretion where there is a breach of these Terms, suspected fraud, misuse of the Platform, or violation of applicable laws.

SERVICE DESCRIPTION

Caanta Market is an online marketplace that enables users to publish announcements, view listings, and communicate directly with other users using contact details provided in listings.

The Administrator is not a manufacturer, seller, buyer, importer, exporter, distributor, or service provider of any goods or services listed on the Platform. All transactions are conducted directly between users.

Users are solely responsible for determining and paying any applicable taxes arising from their use of the Platform.

The Administrator may remove or restrict access to content where required by law, upon valid intellectual property complaints, or where content violates these Terms.

POSTING OF ANNOUNCEMENTS

Users may be required to submit identification or supporting documents for verification purposes.

All announcements must be accurate, lawful, and compliant with these Terms and applicable laws.

When uploading third-party media or links, you agree to comply with the terms of service of the relevant third-party platform.

FEES

The Platform may offer free and paid features. Applicable fees, limits, and payment methods are displayed on the Platform.

All fees are non-refundable except where required by law. The Administrator reserves the right to modify fees at any time.

USER REPRESENTATIONS AND WARRANTIES

By using the Platform, you represent and warrant that:

• You have the legal capacity to enter into these Terms
• You are at least 18 years old
• All information you provide is accurate
• You will comply with all applicable laws
• You have lawful authority to post or sell listed goods or services

Prohibited content includes illegal goods, counterfeit products, misleading listings, scams, pornographic material, hate speech, violent content, and intellectual property infringements.

INDEMNITY

You agree to indemnify and hold harmless Davors Facilities Management Services Limited, its officers, employees, affiliates, and partners from any claims, losses, damages, or expenses arising from your use of the Platform, User Content, or breach of these Terms.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ADMINISTRATOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

THE TOTAL LIABILITY OF THE ADMINISTRATOR SHALL NOT EXCEED THE LESSER OF:

• THE AMOUNT PAID BY YOU TO THE PLATFORM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR
• GHS 460

INTELLECTUAL PROPERTY RIGHTS

You retain ownership of User Content you submit. By posting content, you grant the Administrator a non-exclusive, worldwide, royalty-free licence to use such content in connection with the Service.

All Platform trademarks, logos, and proprietary content are owned or licensed by Davors Facilities Management Services Limited.

INTELLECTUAL PROPERTY INFRINGEMENT

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of Ghana.

Any dispute arising out of or relating to these Terms shall be resolved by arbitration at the Ghana Arbitration Centre, conducted in English.

MISCELLANEOUS

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force.

The Administrator may assign its rights and obligations without restriction.

Failure to enforce any provision shall not constitute a waiver.
